1. Acceptance of Terms

By accessing or using TipnChip (the "Platform", “Website, “Web App”), you agree to be legally bound by these Terms of Use. These Terms establish the rights and obligations between you and TipnChip. If you do not agree to these Terms, you must immediately cease using the Platform. Your continued use of the Platform signifies your acknowledgment and acceptance of these Terms. We reserve the right to modify these Terms at any time, and such modifications will become effective upon posting. It is your responsibility to review these Terms periodically for any changes.

2. Eligibility

TipnChip is only available to individuals who are at least 13 years old. By using this Platform, you affirm that you are of legal age to form a binding contract under applicable law. If you are accessing the Platform on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you are under 13, you are not advised or permitted to create an account or engage in any activities on this Platform. Our Service does not address anyone under the age of 13 (“Children”). We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us. If we discover that a child under 18 has provided us with Personal Information, we will delete such information from our servers immediately.

3. Account Registration

To use the features offered by TipnChip, you must create an account by providing accurate and complete information, including but not limited to your full name, email address, chosen username, and password. You agree to maintain the confidentiality of your login credentials and are solely responsible for all activities occurring under your account. If you suspect unauthorized access to your account, you must notify us immediately. TipnChip is not responsible for any loss or damages resulting from unauthorized account access.

4. Content Pages

Users may create branded pages to receive tips and donations from the public for the goods and services they're offering. When setting up a page, you must provide truthful, transparent, and accurate information regarding your content, social profiles, and purpose of page creation. Misrepresenting facts, misleading public, or engaging in fraudulent activities will result in the immediate suspension or termination of your account. You are solely responsible for any commitments or promises made on your page and must comply with all applicable laws governing financial transactions.

5. Verified Subscription

TipnChip offers users an option to obtain a verified status for a monthly fee of $2.99. This subscription is billed on a monthly basis and is non-refundable under any circumstances. The verified badge is intended to build trust within the community but does not imply endorsement by TipnChip. Failure to pay the monthly subscription fee may result in the removal of your verification status.

6. Payments and Stripe Integration

TipnChip facilitates payments and financial transactions through third-party payment processor Stripe. To receive payments, creators must link their bank accounts to Stripe and comply with Stripe’s terms of service. TipnChip does not process payments directly and is not responsible for any issues arising from failed transactions, chargebacks, delays, or withheld funds. You acknowledge that all transactions are subject to Stripe’s policies and that TipnChip has no liability regarding payment disputes or lost funds.

7. Prohibited Content

Users are strictly prohibited from posting, sharing, or distributing any content that violates legal, ethical, or community guidelines. Prohibited content includes but is not limited to pornography, child exploitation, hate speech, threats of violence, harassment, illegal activities, fraudulent schemes, and any material deemed harmful or offensive by TipnChip. Users found engaging in such activities will face immediate account suspension and may be reported to the appropriate legal authorities.

8. 18+ Content

TipnChip allows creators to mark their pages as "18+" if they contain adult-oriented content. Users must be 18 years or older to view or contribute to such pages. TipnChip reserves the right to review and remove any content that does not comply with our content policies, even if labeled as "18+." Creators remain responsible for ensuring that their content is legally compliant and does not contain prohibited material. Content marked as 18 may be subject to approval by TipnChip.

9. Account Termination and Deletion

TipnChip reserves the right to suspend, terminate, or restrict user accounts that violate these Terms, engage in fraudulent activities, or otherwise harm the integrity of the Platform. Users who wish to delete their accounts may request deletion, which will result in the removal of their profile and personal information from public view. However, certain data may be retained as required by law or to comply with regulatory requirements.

10. Disclaimers and Liability Limitations

TipnChip is provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee uninterrupted access to the Platform or that it will be free of errors, bugs, or security vulnerabilities. Users assume all risks associated with using TipnChip. To the fullest extent permitted by law, TipnChip disclaims all liability for damages, financial losses, or other harm resulting from your use of the Platform.

11. Changes to Terms

TipnChip may update these Terms at any time without prior notice. Changes become effective upon posting, and continued use of the Platform after any modifications constitutes acceptance of the updated Terms. We encourage users to periodically review these Terms to remain informed of any changes.

12. Governing Law

These Terms of Use are governed by and interpreted in accordance with the laws of Nassau County, New York. Any disputes arising from or related to these Terms shall be resolved in the appropriate courts of Nassau County, New York.
